Rightful Overages

Terms of Service

Last updated: August 2026

These Terms of Service ("Terms") govern your use of the Rightful Overages website and the services we offer. By using our site or working with us, you agree to these Terms. Please read them carefully.

Who We Are and What We Do

Rightful Overages helps former property owners recover surplus funds (also called overages or excess proceeds) that may be owed to them after a property was sold at a tax sale for more than the taxes owed. We are a private company. We are not a government agency, and we are not a law firm. We do not provide legal advice.

No Guarantee of Results

We cannot and do not guarantee that you are owed surplus funds, or that any claim will be successful. Whether funds exist, and whether a claim can be recovered, depends on the specific facts of your situation and the rules of the county and state involved. Information on this website is provided to help you understand the process and is not a promise of any particular outcome.

Our Fees

When you choose to work with us, we work on a contingency basis. This means you pay no upfront cost, and we are paid a percentage of the funds only if we successfully recover money for you. If we do not recover anything, you owe us nothing for our recovery service.

Our fee is capped at 30% and is often lower, because it never exceeds the legal limit in the state where the property was sold. The exact percentage for your claim is set and disclosed to you in writing before you agree to anything. The specific terms of any engagement are governed by the separate written agreement you sign with us, which controls if there is ever any conflict with these Terms.

You Can Pursue a Claim Yourself

We believe in being upfront: you are not required to use us or anyone else to claim surplus funds. In many cases you can pursue a claim on your own directly with the county. What we offer is handling the entire process for you, including the research, the county-specific paperwork, the deadlines, and the filing costs, so a claim that is rightfully yours is not denied over a technicality or a missed deadline.

Your Responsibilities

If you work with us, you agree to give us accurate and complete information, to not knowingly provide false or misleading details, and to not use our services for any unlawful purpose. Providing inaccurate information may delay or prevent recovery of funds.

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Continuing to use the site after changes means you accept the updated Terms.
